This is the privacy policy for Friendly’s products and website.

Introduction

Friendly stores and processes all customer data in accordance with applicable laws such as the new FADP (CH) and the GDPR (EU). Friendly does not rent or sell customer data.

Friendly stores and processes all customer data exclusively in Switzerland or in the EU (depending on customer preference) with providers headquartered in the respective region. We do not store customer data in the clouds of tech corporations from the USA.

Privacy at Friendly Automate

Friendly Automate is a service to engage contacts via email, SMS or other channels. Friendly Automate customers can evaluate their contacts’ reaction to the messages and visitors’ behavior on their website.

In doing so, Friendly Automate allows customers to collect and store personally identifiable information (“PII”), which may include contacts’ names, email addresses, phone numbers, job titles, company names and any other PII which our customers choose to request.

The type and amount of information collected about their contacts is determined by the customer. If the customer chooses to use Friendly Automate to collect and track information about their contacts, Friendly Automate will employ technologies such as cookies, beacons, tags and scripts.

Privacy at Friendly Analytics

Friendly Analytics is a service to track and understand the success and reach of a website.

All data stored by Friendly Analytics cannot be attributed to a specific person and is therefore not personally identifiable information (PII). We deliberately do not set cookies.

Our Data Processing Agreement (DPA)

Our Data Processing Agreement (DPA) specifies your and our rights and obligations with regard to data protection aspects – based on the new Swiss Federal Act on Data Protection (nFADP) and the General Data Protection Regulation of the European Union (GDPR).

If you are a customer of ours, you are welcome to sign a DPA with us. Please contact us for this.

Our Data Protection Officer (DPO)

Our Data Protection Officer is Dr. Kathrin Schmid in her capacity as Friendly’s Chief Information Security Officer (CISO).

She is officially registered with the Federal Data Protection and Information Commissioner (FDPIC) (Switzerland) as well as with the Irish Data Protection Commission DPC (EU) in this capacity.

We use Friendly Automate for marketing automation and Friendly Analytics for website analysis.

Data of our customers

We store your e-mail address, your name, your company and your address in order to send you invoices and to comply with our tax obligations.

Relationship EU – Switzerland

Friendly stores all data of customers from the EU exclusively with providers headquartered in the EU (unless otherwise requested by the customer). The data never leaves the EU.

Friendly as a “processor”, however, is headquartered in Switzerland. Switzerland is not a member of the EU and is therefore legally a “third country”. Nevertheless, this does not make any difference for data protection.

This is because the EU has recognized the protection of personal data in Switzerland as equivalent to the EU in an “adequacy decision”.

This means that personal data from EU member states and member states of the European Economic Area (EEA) may be transferred to Switzerland and / or processed by Swiss companies without any further requirements.
